Approved codes of practice (ACoPs)

ACoPs are brought in to supplement Acts and Regulations and provide expert interpretation on how to comply with legislation and how the requirements can best be implemented.

If you follow the advice provided in the ACoP, you will be doing the minimum required to comply with the law in respect of those specific matters to which the ACoP provides advice.

Failure to comply with an ACoP is not an offence in itself. However, if you are prosecuted for a breach of health and safety law, and it is proven that you did not follow the relevant provisions of the ACoP, you may need to show that you have complied with the law in an equal or better way.

ACoPs can be amended without a change in Act or Regulation.
